01 — Our services
The Service
We provide mobile vehicle service, including roadside/emergency support, scheduled maintenance and repair, fleet and residential jobs, and—when offered—parts sales. Service areas and availability are determined by us and may change.
Work is typically performed by independent contractor technicians, not Company employees.
We do not guarantee response times, on-site completion, parts availability, or that every vehicle or condition can be serviced where it is located. We may decline, reschedule, or stop work for safety, legal, access, fraud, practical, or business reasons.
02 — Accounts & eligibility
Accounts & Eligibility
- You must be 18+ and able to form a binding contract.
- You must provide and keep current: accurate contact info, vehicle details, service location, and payment information.
- You are fully responsible for account security and all activity under your credentials.
- You represent that you own the vehicle or have legal authority to authorize inspection, service, payment, and all charges described in these Terms.
- We may suspend or terminate access for non-payment, fraud, abuse, harassment, safety risk, breach of these Terms, or pattern cancel abuse (e.g., repeated booking and cancellation to exploit dispatch windows or avoid fees).
- Termination does not eliminate obligations for fees already incurred or amounts owed; non-refundable fees remain due per §5 and the booking disclosures for that service type.
03 — Service types
Service Types
Emergency / Roadside Assistance
Urgent or roadside dispatch under the fee and cancel rules in §5 and as disclosed at booking.
Scheduled Service
Non-urgent / booked service under the fee rules in §5 and as disclosed at booking.
You must select the correct type. We may reclassify a booking that was clearly mis-selected. Misuse of Emergency (for example, repeated “emergency” bookings for routine work, or repeated cancels timed to the refund window) is a breach of these Terms.
04 — Bookings & fees
Bookings, Fees & Authorization
Payment before dispatch. Applicable dispatch or service fees are charged before we dispatch. We dispatch only after we confirm receipt of required payment.
Fee structure. Fee amounts, what a fee includes (if anything), and how additional labor or parts are billed are shown at booking, checkout, and/or in your job authorization. Those disclosures are part of your agreement for that job.
Pricing and duration. Repair duration varies. Unless we expressly offer a written fixed-price engagement for a defined scope, labor is billed as disclosed at booking or in your authorization (for example, a fee that includes an initial period of on-site labor, then time thereafter, and/or other disclosed rates). Any advance figure for parts is for parts only (plus applicable tax/fees)—not labor and not a promise of total job cost. Diagnosis may reveal additional work; labor and parts charges accrue only for work and materials you authorize. Where Colorado law requires a written estimate and authorization before repair work, we will provide that estimate and obtain your authorization before proceeding with the covered repair.
Authorization. Payment, in-app/SMS/web confirmation, or signed/tapped approval authorizes dispatch and on-site diagnosis as applicable; labor and parts within the scope you approve; and charges to your payment method for amounts you owe under these Terms and the job record—including disclosed fees, additional authorized labor, parts, fluids, taxes, and mandatory location-related fines or reimbursements described in these Terms. We maintain time-stamped records of authorizations, payments, and job documentation.
Changes / extra work. If additional work or parts are needed, we will seek your approval when reasonably practical before proceeding. If limited action is needed for safety and you cannot be reached, we may stabilize the vehicle and pause until we obtain your approval.
05 — Cancellations & refunds
Cancellations, Refunds & Failure to Perform
Cancellation and refund rules depend on service type and are presented at booking and in the job receipt. In general:
- Fees charged to initiate dispatch or reserve on-site service are earned when payment is confirmed.
- After a technician is en route or has arrived, or after work has begun, fees are not refunded because you changed your mind, fixed the issue yourself, provided wrong access/location, or refused service.
- Completed labor is not refunded except under our limited warranty or as required by law.
- We may refuse future bookings or apply different prepayment conditions if we reasonably determine that booking/cancellation patterns, false information, or other conduct is abusive or fraudulent.
Operational details of dispatch timing and staffing are managed by us and are not a menu of customer options beyond the refund rights disclosed at booking.
Abuse: Frequent booking-and-cancel behavior, cancels timed to the refund window without good faith need for service, false urgency, or false locations are grounds to deny future Emergency dispatch, require alternative payment terms, and/or terminate your account. The refund window is a narrow safety valve for our no-show, not a free option on demand.
06 — Parts
Parts
When we sell parts, pricing and any return rules are as disclosed at purchase. Warranty on parts sold through us is limited to whatever transferable manufacturer, supplier, or distributor warranty applies; we provide or pass through available warranty information.
Customer-supplied parts: We may refuse installation. If installed at your request, no warranty applies to those parts or to our labor/service related to them.
Parts-only purchases (when offered) are separate from labor unless you also book installation.
07 — Access & safety
Access, Safety, Authority
You must provide a reasonably safe, legal location and access (keys, codes, animals, parking permission, accurate pin drop). Roadside work has inherent risk; you will follow reasonable safety instructions. We may decline or stop work if conditions are unsafe or unlawful without refund.
08 — Location fines
Location Fines and Costs — Mandatory Reimbursement
You are solely responsible for choosing and providing the vehicle's location and parking/access conditions.
If the Company, any technician, or any contractor is fined, cited, ticketed, charged, assessed, or penalized by any HOA, city, town, county, state, district, property manager, or other authority or person because of the vehicle's location, parking, access, or related restrictions in connection with your job, you will reimburse the Company in full for:
- the full fine, ticket, penalty, or assessment; and
- actual related costs we incur (including payment processing and documented administrative expense we assess under a published schedule or actual out-of-pocket amount).
This reimbursement is mandatory, not optional.
You authorize us to charge your payment method on file for these amounts when we receive notice of the fine or cost.
No refund of the dispatch fee, labor, or parts will be issued because of such fines or because the location was restricted, illegal, or unworkable.
If the location is unworkable or unlawful, we may leave or require relocation at your cost. We have no third-party towing partner unless we expressly arrange one in writing.
09 — Customer conduct
Customer Conduct
No unlawful use; no harassment or threats; no fraud; no interference with systems; no false vehicle/location/payment information; no circumvention of payment, dispatch, or safety processes.
10 — Warranty
Limited Warranty (Labor)
Unless a job receipt states otherwise, we provide a limited workmanship warranty for the specific labor we perform using parts supplied through us: one (1) month or 1,000 miles, whichever occurs first.
Excluded — Not Covered
- Customer-supplied parts and all labor/service related to them.
- Pre-existing conditions, unrelated systems, damage, or diagnosis where repair was declined.
- Misuse, neglect, racing, modifications, collisions, or improper maintenance after service.
- Parts defects beyond any pass-through manufacturer, supplier, or distributor warranty.
- Consequential failures or damage not directly caused by our workmanship.
- Work altered, repaired, or disturbed by anyone other than our authorized technician after our job.
Remedy: At our discretion—re-performance of covered workmanship, other remedy we approve, or refund/partial refund when we determine covered work was not properly completed. Escalated or repeat issues may be reviewed by a Company designee; warranty and refund decisions are made by the Company after review. You must cooperate with inspection and access.
Except for this limited warranty and non-waivable rights, the Service and parts are provided “AS IS.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.
11 — Liability
Limitation of Liability
To the maximum extent permitted by law, we and our technicians, contractors, officers, agents and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages (including alternative transport, lodging, lost profits, or diminished value).
Total liability for claims related to a job is limited to amounts you paid us for that job, except where Colorado law prohibits limitation.
We are not liable for delay or nonperformance due to events beyond reasonable control, including weather, traffic, access failures, parts shortages, or emergencies.
12 — Indemnification
Indemnification
You will indemnify and hold harmless the Company and its technicians, contractors, officers, agents and affiliates from claims and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, lack of authority, inaccurate information, location/access issues and reimbursements under §8, customer-supplied parts, or your negligence or misconduct.
13 — Acceptable use
Acceptable Use & Anti-Abuse
You will not: use the Service unlawfully; harass staff or technicians; commit fraud; interfere with the app/site; circumvent payment or dispatch; provide false location or vehicle data; or exploit cancellation or timing rules to obtain free dispatch or avoid the initial dispatch fee.
We may refuse service, require prepayment changes, and terminate access for abuse.
14 — IP & documentation
Intellectual Property & Job Documentation
Our site, app, brand, and materials are ours. You may not copy or scrape them.
Technicians must upload job content—including photos, notes, diagnostics, and related documents—as a condition of service; that content is provided to us for operations, billing, quality assurance, dispute and warranty resolution, fraud prevention, and legal compliance.
If you upload content through our platform (when enabled), you retain ownership and grant us a non-exclusive license to host, reproduce, and use that content solely to operate the Service, perform your job, and satisfy legal obligations. You represent that all uploads are accurate, lawful, and do not infringe any third-party rights; we may refuse or remove any illegal, infringing, or abusive content.
15 — Privacy
Privacy
See our Privacy Policy.
16 — Termination
Termination
You may stop using the Service at any time; amounts owed remain due. We may suspend or terminate for breach, non-payment, or risk.
Provisions that should survive (fees, §8, warranty limits, liability, indemnity, dispute resolution, severability) survive.
17 — Dispute resolution
Dispute Resolution — Arbitration; Backup Venue Jefferson County
Informal resolution. Before filing a claim, send email or written notice to the contact in §21 and allow 30 days for good-faith resolution.
Binding individual arbitration. Except for carve-outs below, disputes arising out of or relating to these Terms, the Service, or a job are resolved by binding individual arbitration under the Federal Arbitration Act. AAA Consumer Rules (or successor) apply. Proceedings on an individual basis only. Seat: Denver, Colorado (or remote as rules allow).
Class waiver. You and the Company may bring claims only in an individual capacity—not as plaintiff or class member in any class, collective, consolidated, or representative proceeding—to the extent permitted by law.
Carve-outs. Small claims court (individual); temporary injunctive relief for IP, safety, or data security; certain collection actions for unpaid balances as permitted.
Opt-out. You may opt out of this arbitration section within 30 days of first accepting these Terms by sending email or written notice to the contact in §21, including the subject or reference “Arbitration Opt-Out,” your name, and account email.
If arbitration does not apply: Colorado law governs (without conflict-of-law rules that would require another state's law). Exclusive venue: state courts in Jefferson County, Colorado, or federal courts for the District of Colorado.
18 — Updates
Changes
We may update these Terms by posting a new version. Material changes will be communicated in a reasonable manner. We may require re-acceptance before further bookings. Continued use after the effective date is acceptance where permitted by law.
19 — Severability
Severability
If any statement, clause, sentence, or provision of these Terms is held unenforceable, invalid, or unlawful, it will be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed from these Terms. Such holding will not invalidate or render unenforceable any other statement, clause, sentence, or provision, which will remain in full force and effect.
20 — Miscellaneous
Miscellaneous
Entire agreement. These Terms, our Privacy Policy, and the digital authorizations, checkout disclosures, and job records for each booking form the entire agreement between you and us regarding the Service, and supersede any prior or contemporaneous discussions or understandings on that subject.
No waiver. If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later. Any waiver must be in writing and signed by us to be effective.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets or the business.
Notices. We may provide notices to you by account email, SMS, in-app message, or posting in the Service. You are responsible for keeping your contact information current.
Headings. Headings are for convenience only and do not affect interpretation of these Terms.
